Direct Marketing laws

Specialist advice on marketing to indivduals

Sending advertising or marketing to particular individuals by whatever means is deemed to be ‘direct marketing’.  The usual methods are by email, text, automated calls, live calls or through the post.  Whichever method you choose, there are always applicable laws to dictate what you can and can’t do.  Most are to be found in PECR 2003 and the new data protection laws.

All direct marketing is possible, as long as you comply with the rules.  However, if you get it wrong, you may find the ICO at your door with their newly strengthened enforcement powers and fines.

Our solicitors are very experienced in dealing with the direct marketing laws and regularly advise many businesses on the options available and how to stay compliant.  Their experience in dealing with ICO enforcement cases has provided them with a wealth of knowledge in terms of applying the laws, but in a commercially realistic way.  Businesses need to trade and that includes compliant marketing.
