Confiscation Proceedings

Defence solicitors for confiscation proceedings.

Following conviction for any offence from which there has been a ‘benefit’, it is usual for the prosecutor to seek recovery by way of confiscation proceedings under the Proceeds of Crime Act 2002.

They will usually commence this process by freezing the defendant’s assets under a restraint order. The powers under the Act are extremely wide and regularly described as Draconian.

Defendants often face bankruptcy as a result. We have specialist solicitors to advise and assist clients subject to confiscation proceedings. We have an excellent track record of minimising the effects of any such order.
