Restrictive Covenants


The commercial world has become increasingly sensitive to the protection of its assets.

Restrictive covenants are commonly found in both employment contracts and company sale agreements. The idea being to restrict a person from competing – whether that be an employee going to work for a competitor, or a person who has sold a business setting up a new business in competition.

If these covenants are breached, injunctive action can be brought in the High Court to prevent the competition and claim damages.
